1. Acceptance of Terms
By accessing the IWR™ platform you agree to these Terms. If you access the Platform on behalf of an institution, you represent that you have authority to bind that entity. DataNav Solutions™ may modify these Terms with notice; continued use constitutes acceptance of the modified Terms.
2. Definitions
- Platform – the IWR™ software application, interfaces, APIs, and documentation, including IWR™ Pro.
- Institution – any university, athletic department, professional sports team, or organization under a license.
- Athlete User – an athlete accessing the Platform with an institution-issued access code.
- Program Director / General Manager – a coach, administrator, or team executive with program credentials.
- Compliance Officer – compliance staff with read-only credentials.
- Assessment Data – scores, simulation responses, profiles, archetypes, and certification records.
- AI Features – functionality powered by the Anthropic API: Career Path Builder, policy extraction, scenario generation.
3. Platform Access and License
3.1 License Grant
DataNav Solutions™ grants Institution a limited, non-exclusive, non-transferable license to access the Platform during the subscription period for educational and compliance purposes.
3.2 Access Codes
Institution is responsible for generating, distributing, and managing athlete access codes through the Program Director or General Manager dashboard. Access codes may not be shared, sold, or transferred to unauthorized parties.
3.3 Restrictions
You may not: (a) copy or create derivative works; (b) reverse engineer any component; (c) sell or transfer rights; (d) use automated tools; (e) share credentials with unauthorized persons; or (f) use the Platform for any unlawful purpose.
4. Age Requirements
The Platform is designed for individuals age 18 or older. Institutions must ensure that enrolled athletes meet this requirement. DataNav Solutions™ does not knowingly collect information from individuals under age 13, consistent with the Children's Online Privacy Protection Act (COPPA). See our Privacy Policy for details on minors.
5. FERPA Compliance and Educational Records
5.1 Institutional Responsibility
Institutions subject to FERPA are data controllers for student education records generated through the Platform. DataNav Solutions™ acts as a "School Official" with "legitimate educational interest" as permitted under FERPA.
5.2 Data Visibility by Role
Program Directors and General Managers may view Assessment Data for enrolled athletes. Compliance Officers have read-only access to completion status and certification records only – individual simulation responses are not visible to Compliance Officers.
5.3 Data Storage
In the current version, Assessment Data is stored locally on the athlete's device via browser localStorage. See our Privacy Policy for the full data storage framework and roadmap.
6. AI Features
6.1 Infrastructure
Certain Platform features use large language models provided by Anthropic, PBC (the Claude API). Requests route through a secured DataNav proxy and return responses to the user's device. Anthropic's enterprise data policy prohibits the use of API traffic for model training.
6.2 Cost Transparency
AI Features incur usage-based costs at the Anthropic API level. Pilot deployments include a $50 API cap structure described in the Pilot Agreement. Institutions exceeding the cap will be notified before additional charges accrue. DataNav reserves the right to throttle or pause AI Features if usage exceeds the cap.
6.3 No Guaranteed Availability
AI Feature availability depends on third-party providers. DataNav does not guarantee uninterrupted availability of AI Features. Core Platform functionality (assessments, simulations, certificates) does not require AI Features and remains available during AI outages.
7. Data Ownership
Athletes own their personal information and Assessment Data. Institutions have contractual rights to access aggregated and individual Assessment Data for athletes enrolled in their program, subject to the Pilot or License Agreement. DataNav Solutions™ owns the Platform, assessment frameworks, item banks, archetype taxonomies, scoring algorithms, and all related intellectual property.
8. Privacy
Use of the Platform is subject to our Privacy Policy, which is incorporated by reference into these Terms. The Privacy Policy explains what we collect, how we use it, retention periods, and your rights.
9. Intellectual Property
Instant Wealth Readiness™, IWR™, FIRE Scout™, Readiness Scout™, Playbook Identity™, and related marks are trademarks of DataNav Solutions™. The Platform, assessment content, item banks, scoring methodology, archetype matrices, and eight-section report templates are proprietary intellectual property. Reproduction, reverse engineering, or unauthorized distribution is prohibited.
10. Fees and Payment
Pricing is defined in your Pilot or Full License Agreement. Current tier structure (subject to change):
- Single Sport Pilot: $12,500 per program per year
- Revenue Sports: $24,000 per program per year
- Full Program: starting at $48,000 per year
- Consortium / Multi-Institution: custom pricing
Fees are due per the agreed schedule in your Agreement. Unpaid fees past 60 days may result in suspension of Platform access. Refunds are governed by your Agreement.
11. Warranties and Disclaimers
The Platform is provided "as is" and "as available." DataNav Solutions™ does not warrant that the Platform will be uninterrupted, error-free, or that assessment results will produce any particular outcome. The Platform is a developmental tool; it is not a substitute for professional financial, legal, or psychological advice.
FIRE Scout™ and Readiness Scout™ are developmental assessments. They do not determine eligibility, restrict participation, or constitute psychological evaluations. Results reflect decision patterns in modeled scenarios only.
12. Limitation of Liability
To the fullest extent permitted by law, DataNav Solutions™, its officers, employees, and affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to use of the Platform. Total liability for any claim shall not exceed the fees paid by the claiming party in the twelve months preceding the claim.
13. Indemnification
Institution agrees to indemnify and hold harmless DataNav Solutions™ against claims arising from (a) Institution's breach of these Terms, (b) Institution's misuse of the Platform, (c) Institution's failure to obtain required consents from athletes or guardians, and (d) any violation of applicable law by Institution or its Users.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Disputes shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in Travis County, Texas, except that either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property rights.
